Life-Threatening Medical Condition Absence Form HB367

Physician Certification under Texas Law

According to Texas Education Code § 25.087(b)(3), starting in the 2021–2022 school year, schools must excuse absences due to a serious or life‑threatening illness or related treatment—only if the parent or guardian provides a certification from a licensed Texas physician that includes:

  • A description of the child’s illness

  • A statement that it is serious or life‑threatening

  • The anticipated absence period

  • A statement that attendance is infeasible during that period

Beginning in the 2025–2026 school year, HB 367 requires districts to adopt a standardized form for this certification and prohibits requiring any information beyond what’s on that form.

What Parents Need to Do

  • Request or download the school district’s official physician certification form once it’s implemented.
  • Have a licensed Texas physician complete the form by documenting the items listed above.

  • Return the completed form to the school district’s attendance office or campus office—keep a copy for your records.
